MAGIC GAME
These Terms of Service (“Terms”) are a legal agreement between you and MAGIC GAME HONGKONG LIMITED, a company incorporated in the Hong Kong Special Administrative Region (“Magic Game”, “we”, “us” or “our”), governing your use of our mobile games, applications, and the website at magicgamehk.com (together, the “Service”). By downloading, installing, or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your country, up to 16 in the EEA and the UK) to use the Service. If you are a minor, you may use the Service only with the involvement of a parent or guardian.
The Service is provided for your personal, non-commercial entertainment. We may update, change, or discontinue features from time to time. Some features require an internet connection and a compatible device.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control, for personal use only. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restriction is prohibited by applicable law.
Where the Service allows you to create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and keep it up to date. You may delete your account at any time as described in our Privacy Policy. We may suspend or terminate accounts that violate these Terms.
The Service may display advertising and may offer rewards in exchange for viewing ads. Rewards are granted at our discretion, subject to availability and to the terms of the advertising partner. Attempting to manipulate ad delivery or reward mechanics is a breach of these Terms.
If the Service lets you submit content (for example, nicknames, messages, or levels), you keep ownership of it and grant us a worldwide, non-exclusive, royalty-free licence to host, display, and use it as needed to operate and promote the Service. You must not submit content that is unlawful, infringing, harassing, hateful, or otherwise objectionable. We may remove content that violates these Terms.

The Service, including its software, artwork, characters, music, text, and trademarks, is owned by Magic Game or its licensors and protected by intellectual-property laws. These Terms grant you no rights other than the licence described in Section 2.
The Service may include links to, or integrations with, third-party services such as app stores, advertising networks, and analytics providers. Those services are governed by their own terms and privacy policies, and we are not responsible for them.
If you obtained the Service through the Apple App Store:
If you obtained the Service through Google Play, you also agree to the Google Play Terms of Service. If there is a conflict between these Terms and the Google Play Terms of Service regarding your use of the Service obtained through Google Play, the Google Play Terms of Service prevail to the extent of the conflict. Google is not a party to these Terms and has no responsibility for the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC GAME HONGKONG LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD 50. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FRAUD.
You agree to indemnify and hold harmless Magic Game and its officers, directors, employees, and agents from claims and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
These Terms remain in effect while you use the Service. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. On termination, the licence in Section 2 ends and you must stop using the Service. Sections that by their nature should survive termination will survive, including Sections 8, 11, 12, 13, and 16.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and, where appropriate, notify you in-game. Continued use of the Service after changes take effect means you accept the updated Terms.
These Terms and any dispute arising out of or in connection with them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. The courts of Hong Kong have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
